Terms of Service
"These Terms of Service ('Terms') are applicable to the use of all products and services offered by oddsbit.net, Inc., its subsidiaries, and affiliates (referred to as 'OddsBit', 'our', or 'us'). This encompasses our range of online platforms, including our websites, software applications, social media pages, and other digital services, all of which are collectively known as the 'Services'."
1. AGREEMENT TO TERMS
Please review these Terms attentively. By accessing or using the Services, you acknowledge having read and understood these Terms, which govern your use of the Services. You also consent to them. By agreeing to these Terms, you and OddsBit agree, as detailed in section 16, to resolve most disputes individually through arbitration where law permits, excluding jury trials, class arbitrations, class actions, or other representative or court proceedings. If you disagree with these Terms, refrain from using the Services.
2. ADDITIONAL TERMS
Certain Services might be governed by specific or additional terms. These terms, unless otherwise stated, complement and are a part of these Terms, prevailing in case of any conflict with these Terms. Examples of such additional terms include, but are not limited to, the OddsBit Gift Card Terms and Conditions.
3. SERVICE USE
Eligibility and Account Registration for the Services require users to be at least 16 years old. Minors need guardian consent. Guardians are accountable for minors' use of the Services. Account registration demands accurate, updated information and secure management. Users must report unauthorized access. Responsibility for activities linked to the account lies with the user. Those previously removed from the Services are prohibited from creating new accounts, except with explicit permission.
4. SUBSCRIPTIONS
Access to OddsBit Premium through a OddsBit tipster subscription is possible as part of an agreement between OddsBit and your employer or another organization. To gain access, you must follow your organization's instructions based on its agreement with OddsBit. Your access to OddsBit Premium via a OddsBit subscription may be governed by additional terms with your organization. Your rights to use OddsBit Premium under this subscription end when your eligibility expires.
5. OTHER PAYMENTS TERMS
a. Payment Method. When purchasing through the Services, you need to use a valid, up-to-date payment method. You give permission for charges to be made to your selected payment method, including the purchase price, taxes, and fees. A transaction is only final once confirmed by the company. They may update your payment details based on information from payment providers, and you authorize continued charges to the updated method. You're responsible for any extra charges by your payment provider.
b. Cancellations and Disputes. If you have issues with transactions, these should first be addressed with OddsBit rather than your payment provider, unless you've already tried resolving it with OddsBit or are compelled by law. OddsBit maintains the right to verify your identity and gather additional information related to your purchases. It also holds the authority to refuse or cancel purchase requests in situations like suspected fraud or if your payment method is declined.
c. Refunds. OddsBit only offers refunds for payments in circumstances where they are explicitly required by the prevailing legal regulations.
6. SERVICES AND USER CONTENT RIGHTS
a. OddsBit Services Ownership. OddsBit and its licensors retain exclusive ownership of all rights, titles, and interests in the Services, including all content and associated intellectual property. The Services are protected by U.S. and international intellectual property laws. You must not modify or hide any copyright or other proprietary notices on the Services. You are not permitted to copy, distribute, modify, create derivatives, or publicly display or perform any part of the Services beyond what is allowed for your permitted use.
b. Limited License Granted by OddsBit. OddsBit offers you a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use of its Services, unless otherwise permitted in writing. This includes downloading and installing any mobile app provided by OddsBit on your personal mobile device. Unauthorized use beyond this scope is prohibited, may result in license termination, and infringes intellectual property rights. OddsBit may automatically update their mobile apps on your device, depending on your device settings.
c. Limited User Content Ownership. OddsBit respects the ownership of User Content, which includes messages, images, text, or other materials posted by users, even if it's tagged with OddsBit's account or uses a hashtag related to OddsBit. This content doesn't include any part of the Services. The terms confirm that your rights to use and exploit your User Content aren't restricted by OddsBit, except for the licensing rights you grant to them.
d. License You Grant To OddsBit. By sharing User Content with OddsBit, you grant them a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute your content in various media. This includes the right to modify and create derivative works. Your User Content may be used for operating and promoting the Services, and you waive certain rights where allowed by law. You must ensure your User Content doesn't infringe on others' rights or cause harm.
7. THIRD-PARTY CONTENT
The Services may include or link to content and resources from third parties, known as "Third-Party Content". While this is offered for convenience, OddsBit neither controls nor endorses it and makes no guarantees about its accuracy or reliability. Your interaction with such content is at your own risk and responsibility, subject to applicable laws.
8. COPYRIGHT COMPLAINTS AND REPAT INFRINGER POLICY
For claims of U.S. copyright infringement, see 17 U.S.C. § 512(c)(3) for proper notification requirements. Be aware that false claims of infringement on the Services can lead to liability for costs and damages. OddsBit enforces a policy to terminate accounts of users who are repeat infringers of intellectual property rights, in line with the Digital Millennium Copyright Act and other laws.
9. TRADEMARKS
OddsBit's trademarks, such as its name, various program names, logos, and the overall look and feel of the Services, are protected and cannot be used without prior written permission from OddsBit. This list is not exhaustive, and not mentioning a trademark here doesn't imply a waiver of any rights regarding that mark. The mention of third-party trademarks on the Services indicates ownership by respective parties and does not imply endorsement by OddsBit.
10. TERMINATION
OddsBit may terminate your access or account for violating the Terms at its discretion and in accordance with the law. Termination can occur if you no longer qualify for a OddsBit Business subscription or if your OddsBit Premium subscription was through a third-party promotion and you no longer meet the criteria. You can cancel your account by emailing support@oddsbit.net, but active subscriptions must be canceled separately. Following termination, certain Terms provisions, like ownership and liability limits, will continue to apply.
11. LIMITATION OF LIABILITY
To the maximum extent allowed by law, neither OddsBit nor any other parties involved in the Services' creation or delivery will be liable for indirect damages like lost profits, data loss, goodwill loss, service interruptions, or computer damage. This applies even if OddsBit is aware of potential damages. The extent of this limitation varies by jurisdiction, as some don't permit limiting incidental or consequential damages.
12. AGREEMENT TO ARBITRATE
All disputes, claims, or controversies related to these Terms or the Services, including privacy or data security issues, will be resolved through binding arbitration. Each party retains the right to pursue individual claims in small claims court and seek court orders for intellectual property protection. This arbitration agreement covers disputes from events or activities before these Terms' last update.
You have the option to opt out of binding arbitration with OddsBit by sending a written notice within 30 days of agreeing to these Terms. This notice must include your full name and contact details and express your intention to opt out. Opting out means agreeing to settle disputes as outlined in a different section. These Terms are governed by the Federal Arbitration Act, influencing how this section is enforced.
13. MODIFYING AND TERMINATING THE SERVICES
OddsBit reserves the right to modify or discontinue any part of the Services at any time without prior notice, for various purposes like improvements or technical needs. You can choose to stop using the Services whenever you wish. OddsBit is not liable for any loss or harm due to your inability to access or use the Services, within the bounds of applicable law.
14. CHANGES TO TERMS
OddsBit may update these Terms and will notify users, including through email or in-service messages. The date of receiving the email is considered the notification date. Disputes will be resolved under the Terms version effective when the dispute arose. Continued use of the Services after changes implies acceptance of the new Terms. If you disagree with the updates, you should terminate your account and stop using the Services.
